The Long & Winding Road…To A Malaysian PR (Permanent Residence)

Envelopes marked ‘Urusan Seri Paduka Baginda‘ always fill my heart with dread for some reason. That phrase, loosely translated to ‘Affairs of His Majesty’ [NB: Malaysia is a constitutional monarchy] marks envelopes containing official letters come from government agencies, like Lembaga Hasil Dalam Negeri(Bureau of Internal Revenue) and Imigresen Malaysia (Malaysian Immigration).
So when DH handed me such an envelope early Wednesday morning last week, I hastily opened the letter, my eyes scanning the letterhead — Imigresen Malaysia — and the first line of the first paragraph to see if it contained ‘dukacita‘, i.e. regretfully, which always means bad news, or ‘sukacita‘, i.e. with pleasure, which, of course, means good news.
The letter started with sukacita but it took a few minutes to for the implications of the letter to sink into my groggy consciousness.

I did it! Fourteen years of marriage and five children later, I finally get the long-awaited approval for my application for a Malaysian PR (permanent residence)! This marks the end of countless visits to Immigration office. To give you an idea of what I had to go through, I started with a 15-day visa, then 30-day visas (3 times, I think), followed by 3-month visas (3 times?), 6-month visas (2 or 3 times?), then yearly visas (5 of them), each time going there with my long-suffering husband in order to prove that the marriage does exist and that we are still together. I was only able to apply for PR after the 5th yearly visa, which was about 2 years ago. [NB: Malaysian men: If you're thinking of getting a foreign wife, better brace yourself for all this hassle!]
Of course, I have one more visit to make to the main office of Imigresen Malaysia in Putrajaya to submit a bank draft for RM120 (~USD38), a letter of oath signed by my husband and I certifying that we are still married and still together (‘perkahwinan masih kekal‘), my most recent passport-sized photographs, etc for the processing of my PR.
So what comes next? I checked with my cousin to find out. She is also married to a Malaysian and has been in Malaysia for about the same length of time as me. She told me that it took almost 2 years for her to get her red IC (Identity Card) after submission of the bank draft and documents. [NB: Malaysian citizens have blue ICs.] But — here is the big but — she told me that I will still hold a Philippine passport; the only difference is that I won’t have to go to Imigresen anymore to renew my visa every year. She added that she was told that it is possible to apply for citizenship but she’s quite unclear about the procedure.
I guess I’ll just have to take this one step at a time. It’s been a long and winding road but I am thankful to God that I am finally past the first hurdle.

Update 10th June 2012: I finally got my Entry Permit in late 2010 and my red IC (identity card) four months later. With my red IC, I now go through the Malaysian lane in the airport (and even got scolded the one time I queued up at the foreigners’ lane), get the same benefits and rates as Malaysian citizens in government clinics and hospitals, and generally get better treatment in banks and government offices, i.e. like a Malaysian citizen.
The Immigration Department has also introduced a new points system when applying for an Entry Permit: http://eis.imi.gov.my/entry_permit_calc/proses.php. Points are calculated based on one’s age, relationship to a citizen/resident, investment in Malaysia, bank accounts (minimum: RM100,000!), job opportunities provided to Malaysians, Malay language proficiency, etc. The points calculator page also comes with a disclaimer: “Please take note that this assesment tool is only to show your possible points score. Should you wish to apply for an Entry Permit, it will not guarantee a successful application. Successful application depends on your complete application and supporting evidences submitted to the Immigration Department.” I can only foresee the procedures and system to change again in the years to come, as they always have over the years. Wives of Malaysian citizens have probably the best chances of getting a PR, especially once they have children (who will be Malaysian citizens, thanks to their father).

Update 9th September 2014: Apparently, it is possible for the wife of a Malaysian citizen to apply for citizenship after having been a Permanent Resident for two (2) years. Read the details in this post.

    My application was initially submitted in 2004 n rejected in 2009, subsequently I applied again in March 2011(after a wait period of 1 year). I was interviewed by immigration in August 2011 n then by Police in Nov 2011. As of now they haven’t received my police verification report, so I’ve a long wait…..

    Hi KS…
    If there are no accidents, suppose the Immigration has received your Police Clearance from Bukit Aman. Please double check with them. If they have not received it, you can check with Bukit Aman yourself and see what’s going on (The standard processing time for Police Clearance is 6 months). Actually I had the exactly same journey as you did. Below is my application process:
    1st Application:
    Submission: Jan 2007
    Rejection: Feb 2007
    Appeal: Mar 2007
    Rejection: Dec 2009
    After a cooling off period of one year
    2nd Application:
    Submission: Dec 2010
    2nd Interview: Feb 2011
    Police Interview: July 2011
    Approval: Apr 2012

    Kevin just wanted to know as approximately how long it took for you to receive approval letter from Putrajaya after your police interview.? Further after receiving the approval letter what is the procedure?

    From Jul 2011 to Apr 2012, around 10 months. Suppose I could receive approval before Dec 2011, but Bukit Aman sent my Police Clearance to a wrong place, so it took another 4 months to correct the mistake. That’s why I asked you to follow it up closely. After receiving approval, you need to prepare a bank draft RM120 for the Immigration, and you can get Permit Masuk on the same day. After this, go to the JPN to apply for PR I/C. The processing time for the I/C is one month.

    I was told IC processing time depends on one’s nationality. For Filipino passport holders, it takes 4 months. At least, that was the policy when they were processing my IC in 2011. You know how policies tend to change from time to time…

    I called up immigration and I got three different(all possible) replies about my verification report.
    a) It’s in.
    b) Not sure.
    c) Not yet.
    Hopefully a) is true. Kevin & Mimi..how long, do u think it takes for state immigration dept to forward the same to Putrajaya?

    KS… The answer from the Immigration must be precise instead of a tricky one! Otherwise, you will never know what your next step is. Do check with them whether they have received your Police Clearance from Bukit Aman. If they have received it, push them to forward your application to Putrajaya HQ immediately for further process. If they have not, ask them to get the Police to issue Police Clearance asap. Actually I have no idea on this step because I submitted my application in Putrajaya HQ, so this step was skipped. But I know an Indian guy who marries a Malaysian lady at Allo Expat Forum. He obtained PR Status last December. This guy received approval one month later from the State Immigration forwarded his application to Putrajaya HQ. For more details, you could login the link below. I’m sure you will get correct answer there.
    Besides, two questions here.
    1) In which State Immigration you submitted your application?
    2) Where are you from?
    As Mimi said, in Malaysia, the speed of PR application process depends on applicants’ nationality. If you are from a developed country, definitely your application would be processed smoothly and faster. For example, the processing time for I/C for applicants from the ASEAN is 3 – 4 months, but only one month for applicants from the EU, US, Japan, Korea and China (including Hong Kong, Macau & Taiwan).

    NEVER give up, KS… In my view, obtaining PR status for you is just a matter of time as the immigration policy for foreign husbands has been softened since 01 July 2010. If there are no accidents, I’m confident that your PR application will be granted before July or August. Take a deep breath and be patient…

    I’ll collect my IC at the end of this month. So far, I’ve not considered to apply for Malaysian citizenship as Malaysia does not recognize dual citizenship. Once applying for Malaysian citizenship, I have to give up my own citizenship. It’s NOT worthy of doing that.

    Kevin…I was told upon submitting the bank draft / Surat Akuan n photographs .. you got to wait for around 45 days to get a green card and a sticker on your passport, is that so?

    This depends on applicants’ nationality. And it’s the reason why I asked where you are from. For applicants from certain countries, the Immigration used to issue Permit Masuk (Green Card) and stamp in an applicant’s passport (not a sticker) 45 days after receiving payment and relevant documents. I had it on the same day I made the payment.

    I’ve been travelling very frequently the whole time — since I had my social visit pass until I got my red IC. The only time I couldn’t travel was when my passport was being renewed :)

    i just wana ask KS, that i also have submited my application last year in april within one month i get imigration interview then after that i have police interview in nov, i have called imigration to check my application they said they haven;t recive police report from bukit aman i said how to find they said they also don;t dare to ask from them .. then how can i check whether police report has been send it or not..
    kindly advise me, how to check from bukit aman in proper way..

    I’m just waiting patiently, trust me, they are much more efficient now. Looks like the whole system/people have been overhauled. The way they deal with you, reply to you etc is much much better than what it used to be few years back. So just have faith (like me) n wait patiently !

    Hi kevin. once we get our malaysian PR, we can apply for malaysian travel documents which called as Surat Akuan Perjalanan (SAP) valid for 5 years (RM500). we can use it to travel overseas. I just want to ask u, can we travel to certain countries in overseas without visa like malaysian passport holder?

    Actually, you just get your passport stamped and travel as usual…except that with a PR, you will now queue at the Malaysian lane. All other visa rules will depend on the passport that you are holding. But visa application is definitely much easier for Malaysian PR holders.

    Sorry to know your accident…
    In terms of your background and qualification, you are eligible for PR application Category 3. However, you HAVE TO submit your application yourself as the Immigration does not accept any application submitted by agents or consultants. Moreover, according to the current regulations, before submiting your application, you are required to obtain a supporting letter from the Ministry of Transport (MOT). Pls note this letter is VITAL for your application. But it MUST be applied through HR Dept, KTMB instead of yourself. I have a detailed checklist for this application category, and I can send it to you via email if you want (Pls give me you email add). One of my foreign freinds who is working with a foreign shipping line, he is applying for PR Status under this category, so I have a picture of this.

The government just wants to do something for show and pretend that the immigration policy is opened and fair to every one. Did you go through the details of the requirement? I’m sure that only genius and billionaires can reach the minimum score – 65 points.

    Hi there…
    According to the current regulations, if your grand-daugther is 6 years old below, she is eligible for Malaysian PR Status. But make sure her mother is still a Malaysian citizen and has not applied for Singaporean citizenship.

    Not really, KS…
    Actually all approval for PR application is issued by the Immigration HQ effective 01 July, 2010. Before this, foreign wives’ and kids’ PR application processed by State Immigration, but foreign husbands’ PR application handled by the Home Minister – KDN (Used to be rejected).

    I believe I told you before that the online tracking system is NOT reliable at all (Refer to my early input). Well, after your security check is done, the PDRM will send your Police Clearance Cert. to the State Immigration. After that, the State Immigration will forward your application folder to the Immigration HQ for final assessment. Take note that the PDRM won’t tell you the result of your security check no matter what the result is. Check the status with the State Immigration where your application submitted to is the only way.

    You just check with the State Immigration whether your application folder has been forwarded to the Immigration HQ. If it is done, this means the PDRM has got your Police Clearance Cert. done, and your application will be likely approved within a month.
    Yes, I collected MyPR at the JPN Putrajaya at the end of May, it took 3 weeks to process. I followed up the processing progress weekly.

    According to your input above, you just got marry 2 years ago. So I’m afraid that you still have a long way to go. In Malaysia, foreign spouses are allowed to submit PR application after consecutive stay for 5 years. In short, you can go to the Immigration with your hubby and submit your PR application in 2015. Be patient and good luck…

    Settled in Malaysia since 2005. I applied to Permit masuk on September’10 (Within that 5year i didn’t visit my home country. Around May’11 went to police interview and On July’11 immigration send me a letter to send me a updated visa copy. Lucky by gods grace i got my permit masuk today.
